1Definitions
In these Terms and Conditions, unless the context otherwise requires:
- "Agreement" means the contract formed between you and Da Vinci Travels & Tours Pty Ltd upon completion of a booking, incorporating these Terms & Conditions.
- "We", "Us", "Our" or "Da Vinci Travels" means Da Vinci Travels & Tours Pty Ltd (ABN 86 630 721 658), an ATIA-accredited travel agent.
- "You" or "Customer" means the person making the booking and any passengers included in that booking.
- "Booking" means your confirmed order for travel services arranged by us on your behalf.
- "Carrier" means any airline or transport provider whose services form part of your booking.
- "Supplier" means any third-party provider of travel services including carriers, accommodation providers, and tour operators.
- "Booking Price" means the total amount payable, comprising the supplier fare, applicable taxes, and our service fees.
- "Service Fee" means our agency fee for arranging your travel, as disclosed in your quote.
- "Fare" means the base price of a flight as set by the Carrier, exclusive of taxes and our fees.
2Our Role as Your Travel Agent
2.1 Agent Relationship
Da Vinci Travels acts as an agent on your behalf when making reservations with Carriers and other Suppliers. We are not the provider of the underlying travel services. Contracts of carriage and service agreements are concluded directly between you and the relevant Supplier.
2.2 Supplier Terms
Our Terms & Conditions are in addition to the terms and conditions of any Carrier or Supplier. In the event of a conflict regarding the supply of a Supplier's services, the Supplier's terms will prevail. We strongly recommend you read all Supplier terms before confirming your booking.
2.3 Information & Advice
We provide quotes and information in good faith based on what is available to us at the time. We do not warrant that information about visa requirements, health requirements, or travel advisories is complete or current. Verifying all such requirements is your responsibility.
3Acceptance of Terms
3.1 Binding Acceptance
These Terms & Conditions are provided before any sale is completed. By confirming your booking, you acknowledge that you have:
- received, read, and understood these Terms & Conditions;
- accepted these Terms & Conditions on behalf of yourself and all passengers in the booking; and
- obtained all necessary consents from other passengers to enter into this Agreement on their behalf.
3.2 Written Confirmation Required
No booking will be finalised and no tickets will be issued until we receive written confirmation from you (by email, WhatsApp, or Messenger) that you have read and accepted these Terms & Conditions.
3.3 Amendments
We reserve the right to amend these Terms & Conditions at any time. Amendments will not affect bookings confirmed prior to the effective date of the change.
4The Booking Process
4.1 Booking Steps
A booking is considered confirmed once all of the following steps are completed:
- 1You submit a travel enquiry with your requirements.
- 2We provide a written quote itemising the fare, taxes, and our service fees.
- 3We provide these Terms & Conditions for your review.
- 4You provide written confirmation that you have read and accepted these Terms & Conditions.
- 5Full payment of the Booking Price is received and cleared.
- 6We issue your booking confirmation and e-tickets by email.
4.2 Passenger Name Accuracy
All passenger names must exactly match the relevant passport. Errors in passenger names may result in additional fees, denied boarding, or the need to rebook at full cost. Da Vinci Travels is not liable for costs arising from name errors you provided.
4.3 Fare Volatility
Fares are set by Carriers and are not guaranteed until tickets are fully paid and issued. We will notify you of any fare change before proceeding.
5Passports, Visas & Health Requirements
5.1 Your Responsibility
It is your sole responsibility to ensure all passengers hold correct and valid travel documents for the entire journey, including all transit stops. This includes:
- a valid passport with a minimum of six (6) months validity beyond your return date;
- required visas for destination and transit countries;
- electronic travel authorisations (e.g., ESTA for the USA, eTA for Canada); and
- any health documentation required at your destination.

5.3 Denied Boarding
Da Vinci Travels accepts no responsibility and will not provide any refund for costs arising from a passenger being denied boarding or entry due to insufficient or incorrect documentation.
6Quotes & Itineraries
6.1 Quote Contents
All quotes clearly itemise: the airline and all flight segments, the base fare and applicable taxes, our service fee, and any other relevant charges.
6.2 Quote Validity
Quotes are valid only for the period specified. After that period, or if seats at the quoted fare sell out, the price may change. We will provide an updated quote before proceeding.
6.3 Connecting Flights
Where your itinerary includes separately ticketed connecting flights, you are responsible for allowing sufficient transit time, collecting and re-checking baggage, and obtaining any required transit visas. Da Vinci Travels is not liable if you miss a connection on a separately ticketed itinerary.
7Schedule of Fees
The following fees apply per passenger unless otherwise stated. All amounts are in Australian Dollars (AUD) and will be itemised on your invoice.

7.2 Airline Fees
Airline-imposed fees and penalties are in addition to our service fees, are set solely by the relevant Carrier, and are beyond our control.
8Cancellations & Refunds
8.1 Voluntary Cancellations
If you choose to cancel your booking for personal reasons:
- A Da Vinci Travels service fee of $50 AUD per passenger applies.
- Airline cancellation penalties and non-refundable taxes also apply under the Carrier's fare rules.
- The refundable amount (if any) is determined by the Carrier, not Da Vinci Travels.
- We will process your cancellation and seek any available refund from the Carrier on your behalf.
8.2 Involuntary Cancellations
If your flight is cancelled by the Carrier:
- A $50 AUD per passenger processing fee applies for our administrative work.
- Your rights to a refund or rebooking are governed by the Carrier's policies and applicable law (including the Australian Consumer Law).
- We will act on your behalf to request refunds or alternative arrangements from the Carrier.
8.3 No-Show Policy
If you fail to show for a scheduled flight without giving at least 72 hours notice, a $50 AUD per passenger fee applies and the Carrier's no-show rules apply — the ticket may be forfeited entirely.
8.4 Refund Processing Time
Airline refunds typically take 7 to 8 weeks or longer, depending on the Carrier. Da Vinci Travels will forward any refund received to you promptly after deducting applicable fees.
8.5 Our Service Fee
Our service fee is non-refundable in all circumstances, except where we have failed to perform our agency obligations.
9Flight Schedule Changes & Disruptions
9.1 Carrier-Initiated Changes
Airlines may change schedules, cancel routes, or alter departure times at any time. Da Vinci Travels is not responsible for any costs or inconvenience from Carrier-initiated changes.
9.2 Checking Your Flight
We recommend checking your flight status 48 hours before departure via the airline's website using your booking reference.
9.3 Our Assistance
If we become aware of a significant change affecting your booking, we will notify you and assist where possible in seeking alternatives or refunds. Our standard processing fee of $50 AUD per passenger applies for any rebooking or refund processing we undertake.
9.4 Force Majeure
Da Vinci Travels is not liable for costs, losses, or delays arising from circumstances beyond our reasonable control, including natural disasters, pandemics, war, civil unrest, government restrictions, industrial action, or airline insolvency.
10Check-in & Reconfirmation
10.1 Reconfirm Flights
Reconfirm all flights with the airline at least 48 hours before each scheduled departure. Verify check-in times and terminal information directly with the airline.
10.2 Special Services
Reconfirm any special services (meals, wheelchair assistance, seat selections) directly with the airline at least 4 business days prior to departure.
10.3 Airport Arrival
We recommend arriving at the airport at least 4 hours before international departures. Failure to check in on time may result in denied boarding with no refund.
11Baggage Allowance
Baggage allowances vary by airline, fare class, and route. Your confirmed ticket specifies your allowance. Infants (under 2 years) are typically entitled to 10 kg of checked baggage. Excess baggage fees are charged directly by the airline at check-in. Da Vinci Travels is not liable for baggage loss, damage, or delay — these matters are governed by the Carrier's conditions of carriage and applicable international conventions.
12Transit Hotels / STPC
Some airlines offer complimentary transit accommodation (STPC — Stopover at Carrier's Cost) for long layovers. Availability is entirely at the airline's discretion and subject to change. You are responsible for confirming your entitlement directly with the airline and for obtaining any required transit visas.
13Travel Insurance
Da Vinci Travels strongly recommends comprehensive travel insurance for all travellers. Insurance can cover: trip cancellation or curtailment, medical and hospital expenses, emergency evacuation, travel delay, missed connections, loss or theft of baggage, and personal liability.
Da Vinci Travels does not provide travel insurance products. We recommend consulting an insurance provider or financial adviser. Failure to obtain adequate insurance is at your own risk.
14Limitation of Liability
14.1 Agent Liability
Da Vinci Travels acts only as an agent for Carriers and Suppliers. We are not liable for:
- any act, omission, default, or negligence of any Carrier or Supplier;
- injury, damage, loss, delay, or expenses from events beyond our control;
- cancellation, delay, rescheduling, or overbooking by a Carrier;
- failure to obtain required visas, health requirements, or travel documents; or
- changes you make directly with a Carrier without our knowledge.
14.2 Australian Consumer Law
Nothing in these Terms & Conditions excludes or limits any rights you may have under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)) that cannot be excluded.
15Complaints & Dispute Resolution
15.1 Contact Us First

15.2 ATIA Accreditation
Da Vinci Travels & Tours Pty Ltd holds ATIA accreditation. ATIA sets the benchmark of quality for the travel industry and assists in resolution of complaints under the ATAS Code of Conduct. If your complaint cannot be resolved directly with us, you may refer it to ATIA at www.traveltick.com.au.
15.3 Governing Law
These Terms & Conditions are governed by the laws of Australia. Any dispute that cannot be resolved through ATIA may be referred to the relevant courts of Australia.
16General Provisions
16.1 Entire Agreement
These Terms & Conditions, together with your booking confirmation and applicable Supplier terms, constitute the entire agreement between you and Da Vinci Travels in relation to your booking.
16.2 Severability
If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
16.3 Privacy
Your personal information is collected and handled in accordance with our Privacy Policy and in compliance with the Privacy Act 1988 (Cth).
